DUI Penalties in Gainesville, Florida

FIRST TIME OFFENSE

  • Jail: If the blood alcohol concentration (BAC) is below 2.0: up to 6 months in county jail.  If the BAC is 2.0 or higher, up to 9 months in jail.
  • Fines:  $250 - $1,000 (dependant on blood alcohol concentration.)
  • License Suspension:  180 days to 1 year.
  • Conditional License:  Yes, but must attend and complete DUI school first.
  • Vehicle Impoundment:  Up to 10 days.
  • DUI School:  Must complete 12 hours of DUI School.
  • Probation:  1 year maximum probation.

SECOND TIME OFFENSE

  • Jail:  Up to 9 months in county jail.  However, if it is the second conviction within 5 years, up to 12 months in jail and mandatory 10-day imprisonment.
  • Fines:  $500 - $2,000 (dependant on blood alcohol concentration.)
  • License Suspension:  180 days to 1 year.  Minimum suspension of 5 years if the second DUI conviction was within 5 years of the first DUI conviction.
  • Vehicle Impoundment:  30 days if second DUI conviction was within 5 years of the first DUI conviction.
  • DUI School:  Must complete 21 hours of DUI School.
  • Probation:  1 year probation.

THIRD TIME OFFENSE

  • Jail:  30 days to 12 months if the third conviction is within 10 years of first and second DUI convictions.
  • Fines:  $1,000 - $2,500 (dependant on blood alcohol concentration.)
  • License Suspension:  Typically, permanent driver’s license suspension.
  • Vehicle Impoundment:  Mandatory 10 day period.
  • Vehicle Interlock Device:  Minimum 2 years.
  • DUI School:  Must complete DUI school and may also have to enter into mandatory drug and alcohol treatment.
  • Probation:  1 year probation.
